These Terms of Use ("Terms") govern use of drago-ai.com and the Drago Works service at app.drago-ai.com (the "Service"), provided by Drago Works, LLC ("Drago Works," "we," "us"). By using the Service, you agree to these Terms on behalf of yourself and the business you represent (the "Subscriber").

The Service

Drago Works is business software for contractors: estimating, scheduling, crew and field tools, customer management, and connections to services such as QuickBooks, Meta lead ads and CloudTalk.

Early access

The Service is offered in early access. Features may change, be added or be removed, and the Service may occasionally be unavailable while we improve it.

Accounts

• Each user needs their own account and must keep their sign-in details and two-step sign-in device secure.
• The Subscriber decides who in its company has access and what role they have, and is responsible for activity under its accounts.
• Tell us right away at dave@drago-ai.com if you suspect unauthorized access.

Your data

• The Subscriber owns the business data it enters, imports or connects ("Subscriber Data").
• The Subscriber gives us permission to host, process and display Subscriber Data only to provide and support the Service, as described in our Privacy Policy.
• The Subscriber is responsible for having the right to use the data it brings in, including customer contact details, and for any required consents, such as consent to receive text messages.
• The Subscriber can export its data at any time.

Connected services

When you connect a third-party service (such as Intuit QuickBooks, Meta or CloudTalk), your use of that service is also governed by its own terms. We are not responsible for third-party services, and a connection can be turned off at any time.

Acceptable use

You agree not to:

• Use the Service for anything unlawful, including sending messages without required consent.
• Try to access another Subscriber's data or bypass security controls.
• Interfere with, overload or reverse-engineer the Service.
• Resell or provide the Service to others without our written permission.

Fees

Fees, if any, will be agreed in writing or shown before you are charged. Early access may be offered at no cost or at a founding-member rate.

Our property

The Service, its software and its design belong to Drago Works. These Terms do not transfer any ownership to you.

Ending use

You may stop using the Service at any time. We may suspend or end access if these Terms are broken or to protect the Service and its users. After an account ends, the Subscriber may request an export of its data for 30 days.

Disclaimers

The Service is provided "as is" and "as available." Estimates, schedules, financial figures and other results depend on the information you enter; you remain responsible for your business decisions, prices and records.

Limitation of liability

To the extent the law allows, Drago Works is not liable for indirect, incidental or consequential damages or lost profits, and our total liability is limited to the amount paid for the Service in the 12 months before the claim.

Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

Changes

We may update these Terms and will post the new version on this page with a new effective date.
